Omah Martimbang

These Terms & Conditions apply to all bookings, payments, reservations and use of Omah Martimbang by a client, organiser or authorised representative.
They are intended to be read together with the invoice, receipt, applicable Catalogue / Price List, House Rules, Vendor Terms & Conditions for any External Vendor appointed by the Client, and any written approval issued by Omah Martimbang.
1. About Omah Martimbang
Omah Martimbang is an intimate event and wedding venue located at Jl. Martimbang V No. 3, Gunung, Kebayoran Baru, South Jakarta, Indonesia (the "Venue").
The Venue may be used for private events such as lamaran, pengajian, siraman, akad, wedding receptions, meetings, gatherings, wellness activities, photoshoots and other approved social or private events.
2. Definitions
- "Client" means the individual, group, company or organisation named on the invoice or receipt, including any person acting for that party.
- "Booking" means the event arrangement validated by the invoice issued by Omah Martimbang and the receipt issued after payment.
- "Event Date" means the confirmed date stated in the invoice or receipt.
- "Catalogue" means the Omah Martimbang catalogue, price list, quotation or package information applicable to the Client's Event Date.
- "Down Payment" or "DP" means the initial payment required to secure an Event Date.
- "Final Payment" means the unpaid balance of the Booking, excluding any later additional charge.
- "Refundable Deposit" means the security amount collected for potential deductions under these Terms.
- "External Vendor" means a third party appointed by the Client, including a decorator, caterer, photographer, videographer, florist, MC, entertainer, rental provider, production provider or other supplier.
- "Time Allocation" means the booked loading-in, Event Time and loading-out periods stated in the invoice, receipt or written approval issued by Omah Martimbang.
- "Force Majeure" means an event beyond the reasonable control of the affected party, as described in Section 17.
3. Acceptance and Booking Documents
By paying a Down Payment, approving an invoice, making any payment, entering the Venue for an event, or permitting any person to use the Venue on the Client's behalf, the Client accepts these Terms & Conditions.
The invoice issued by Omah Martimbang and the receipt issued after payment are the documents that validate the Booking. These Terms & Conditions, the House Rules, the applicable Catalogue / Price List or quotation, the invoice, the receipt, the Vendor Terms & Conditions for any External Vendor appointed by the Client, and written approvals or amendments issued by Omah Martimbang form one agreement. In case of an inconsistency, the order of priority is: written approval, receipt, invoice, applicable Catalogue or quotation, these Terms & Conditions, the Vendor Terms & Conditions where a vendor is involved, then House Rules.
The Client is responsible for ensuring that all guests, family members, committees, representatives and External Vendors comply with the documents above.
4. Reservation and Confirmation
A requested date is not secured until Omah Martimbang receives the Down Payment and sends a receipt. Before then, any tentative reservation is subject to availability and may be released to another client.
If another client requests the same date before the Down Payment has been paid, Omah Martimbang may give the first Client one (1) period of 24 hours to make the Down Payment. If it is not received within that period, Omah Martimbang may release the date to another client without liability.
Omah Martimbang may decline a proposed Booking that is unsafe, unlawful, unsuitable for the Venue, inconsistent with its operating standards, or likely to disturb the surrounding neighbourhood.
5. Client Information and Event Changes
The Client must provide accurate and current details, including name, active contact number, Event Date, event type, estimated guest count, selected package, event schedule, vendor list, billing information, electrical requirements and special operational requests. The Client must promptly notify Omah Martimbang of any material change.
Omah Martimbang is not responsible for delay, disruption, additional cost or loss arising from inaccurate, incomplete or late information supplied by the Client.
6. Package, Venue Access and Catalogue Information
The Client's package, rooms included, facilities, Time Allocation, guest recommendation, parking arrangement, air-conditioning operation, electricity allowance and approved add-ons are those stated in the applicable Catalogue and confirmed invoice or receipt. Package details may differ by booking year, promotion or package tier.
The Venue has a maximum operational capacity of up to 120 persons at one time, subject to the selected package, room layout, decoration, stage size, catering setup, safety conditions and staff instruction. A package recommendation is not a guarantee that a higher guest count can be accommodated safely or comfortably.
The Client may access and use only the rooms and facilities included in the confirmed invoice or receipt. If the selected package does not include the second floor or another area, the Client may not use that area. Package inclusions can be seen in the Catalogue / Price List. Omah Martimbang may restrict access to private, staff-only, storage, maintenance or unsafe areas.
7. Pricing, Invoices and Official Payment Details
All prices are stated in Indonesian Rupiah unless stated otherwise. The Client must review the invoice before payment. The invoice is the official record of the selected package, payment status, applicable Refundable Deposit, add-ons and payment instructions.
Each invoice issued by Omah Martimbang will use the format INVYYYYMM-XXXX, for example INV202606-0001. Payment must be made only to the payment details stated on the invoice. Omah Martimbang is not responsible for money paid to an unauthorised person, fraudulent account, or payment details not stated on the invoice.
The Client must send proof of payment to Omah Martimbang before a receipt can be issued. Each receipt will use the format RYYYYMM-XXXX, for example R202606-0001, and will be sent after the Client pays the invoice and Omah Martimbang verifies the payment.
Prices may change for future enquiries. A Booking validated by invoice and receipt is not affected by later price changes unless the Client requests an upgrade, add-on, date change, additional access, additional time or another change after confirmation.
8. Down Payment
The Down Payment amount follows the applicable Catalogue, quotation or invoice. There is no fixed Down Payment deadline, but the Event Date is not secured until the Down Payment is received and a receipt is issued by Omah Martimbang.
The Down Payment is non-refundable except in a Force Majeure situation approved by Omah Martimbang, or where applicable law requires otherwise.
9. Final Payment and Late Payment
Omah Martimbang will issue the Final Payment invoice on the Monday of the week in which the Event Date falls, unless otherwise confirmed in writing. Final Payment must be received no later than H-3, being three calendar days before the Event Date. The Client must send proof of payment before a receipt can be issued.
If Final Payment is not received by the deadline, Omah Martimbang may, to the extent permitted by applicable law and after reasonable notice where practicable: suspend event preparation; withhold Venue access; decline vendor access; cancel the Booking; and recover any outstanding amount or cost already incurred for the Booking.
10. Refundable Deposit
A Refundable Deposit may be included in the invoice. It is not a payment for the package. It may be used for reasonable deductions directly arising from the Client's event, including overtime, damage, missing items, unpaid additional charges, excessive cleaning, parking costs, or loss caused by the Client, guests or External Vendors.
Where guests or vendors use outside parking areas, including the SPBU field or other external parking areas, the applicable parking fee is the Client's responsibility. Unless otherwise confirmed, outside parking is charged at Rp10.000 per car. Omah Martimbang may pay such parking fees first for operational convenience and deduct the amount from the Refundable Deposit. A breakdown of any parking deduction will be provided together with the Refundable Deposit return calculation.
The Refundable Deposit balance, after applicable deductions, will be returned on the following Monday after the Event, together with a breakdown of any deductions. Omah Martimbang may first inspect the Venue and calculate the amount of any deduction.
If the amount owed exceeds the Refundable Deposit, Omah Martimbang may issue an add-on invoice for the remaining amount and the Client remains responsible for settling the difference.
11. Additional Charges
The Client may be charged separately for approved or incurred additional services, including overtime, extra venue access, extra facilities, furniture or equipment, additional chairs or tables, generator rental, excess electricity requirements, outside parking, special operational requirements, excessive cleaning, loss, damage or other costs caused by the event.
The applicable rate is the rate in the Catalogue, quotation, invoice or written approval in force for the Booking. Charges may be deducted from the Refundable Deposit or invoiced separately.
12. Client Responsibilities
The Client is responsible for timely payment, safe event conduct, accurate information, guest management, vendor management, lawful use of the Venue, and returning the rented areas in proper condition. The Client must ensure that guests and External Vendors respect staff instructions, Venue rules, the Vendor Terms & Conditions where applicable, and the surrounding neighbourhood.
The Client remains responsible for the acts and omissions of all persons attending, working at or entering the Venue in connection with the Client's event.
The Client is responsible for any damage caused by children attending the Event.
13. External Vendors
External Vendors are permitted only subject to the House Rules, this document, the invoice, the receipt and the Vendor Terms & Conditions. The Client must provide Omah Martimbang with the vendor name and PIC contact at least seven (7) calendar days before the Event Date, unless Omah Martimbang agrees otherwise in writing.
The Client is responsible for ensuring that every External Vendor has read, understood and accepted the Vendor Terms & Conditions before arriving at the Venue. Any breach by an External Vendor may be treated as a breach connected to the Client's event, without limiting Omah Martimbang's right to pursue the vendor directly. Omah Martimbang may restrict, refuse or remove a vendor who creates a safety risk, causes damage, breaches the rules, disturbs the neighbourhood, uses unapproved equipment, exceeds the permitted access period or refuses reasonable staff instruction.
14. Damage, Cleaning and Loss
The Client is liable for reasonable repair, replacement, restoration and cleaning costs arising from damage, loss, stains, breakage, misuse or destruction of Venue property caused by the Client, guests or External Vendors. This includes building surfaces, furniture, fixtures, equipment, electrical and air-conditioning systems, plants, toilets, kitchens, parking areas and any other Venue property.
Omah Martimbang may determine the amount using actual repair cost, replacement cost, vendor quotation, professional assessment or a reasonable estimate. Evidence may include photographs, videos, staff records, invoices or quotations.
15. Changes and Rescheduling
Any request to change the Event Date, Event Time, package, guest count, room access, layout, vendor arrangement or add-on must be sent as early as possible. A change is effective only after Omah Martimbang confirms it in writing.
Rescheduling is subject to availability, operational feasibility and the prices applicable to the new date. The Down Payment remains non-refundable and will be treated according to the approved rescheduling arrangement, unless otherwise confirmed in writing or required by applicable law. Omah Martimbang may reasonably limit the number of rescheduling requests.
16. Cancellation
16.1 Cancellation by the Client
If the Client cancels, the Down Payment and Final Payment are non-refundable, except in a Force Majeure situation approved by Omah Martimbang or where applicable law requires otherwise. The Client remains responsible for unavoidable costs already incurred by Omah Martimbang for approved special arrangements, third-party services, equipment, staffing or preparation.
16.2 Cancellation or Stoppage by Omah Martimbang
Omah Martimbang may cancel, suspend or stop a Booking or event if the Client fails to pay on time, gives materially false information, permits unlawful activity, creates a serious safety risk, breaches these Terms or related documents, refuses reasonable staff instruction, or puts the Venue, neighbourhood, staff or reputation of Omah Martimbang at material risk. Where cancellation results from the Client's breach, payments may be retained or applied against costs and losses to the extent permitted by applicable law.
17. Force Majeure
Neither party is responsible for failure or delay caused by Force Majeure, including natural disaster, flood, earthquake, fire, extreme weather, epidemic or pandemic, government restriction, riot, civil unrest, terrorism, war, major utility failure, public emergency, road closure or another event outside the party's reasonable control.
If Force Majeure affects an event, Omah Martimbang and the Client will discuss a reasonable solution in good faith. Omah Martimbang may provide a full refund, rescheduling, a credit or another arrangement subject to availability, documented costs and the circumstances of the event.
18. Safety, Conduct, and Prohibited Activity
Omah Martimbang may take reasonable action to protect people, property and the neighbourhood, including stopping unsafe activity, limiting access, reducing sound, removing disruptive persons, contacting authorities or ending an event.
Illegal drug use, unlawful gambling, weapons, violence, criminal activity, conduct that endangers others, and activities that violate Indonesian law or public order are prohibited. Omah Martimbang may end the event immediately in such cases, without refund to the extent permitted by applicable law.
Alcoholic beverages above 5% alcohol content are prohibited at the Venue unless expressly approved in writing by Omah Martimbang. Omah Martimbang reserves the right to remove or confiscate prohibited alcoholic beverages and/or apply additional charges for any breach of this policy.
The Client agrees that Omah Martimbang's on-site representative has final discretion to determine acceptable sound levels and may require the Client, vendors, entertainers, or guests to reduce sound volume, adjust speaker placement, or stop activities that disturb the neighbourhood.
19. Liability, Personal Belongings and Vehicles
To the maximum extent permitted by applicable law, Omah Martimbang is not responsible for indirect loss, lost profit, business opportunity, emotional distress, disappointment, failure of third-party vendors, guest misconduct, delay caused by the Client or vendors, or interruption caused by Force Majeure.
Personal belongings and vehicles are brought to or parked at the Venue at the owner's risk. Omah Martimbang is not responsible for loss, theft, damage, accident, vandalism or belongings left in vehicles, except to the extent liability cannot legally be excluded.
Where Omah Martimbang is legally liable, its total liability is limited to the amount paid by the Client for the Venue Booking, except where a greater amount is required by applicable law.
20. Photography and Marketing
Omah Martimbang may photograph or record the Venue setup, decoration, atmosphere and event arrangement for documentation and marketing. Omah Martimbang will use reasonable care not to publish close-up images of identifiable guests without permission.
A Client who does not wish the event to be photographed or used for marketing must notify Omah Martimbang in writing before the Event Date. The Client is responsible for obtaining any permission needed for photography or video taken by the Client's own vendors or team.
21. Privacy and Communications
Omah Martimbang may collect and use personal information necessary to handle enquiries, process bookings, issue invoices, communicate with the Client, operate the event, improve services and meet legal or operational obligations. Omah Martimbang does not sell personal information to third parties.
Official communications may be made through WhatsApp, email, invoice notes, website forms or another official Omah Martimbang channel. Messages sent to the contact details supplied by the Client are treated as received unless the Client has notified Omah Martimbang of an updated contact detail.
22. Website Use and Intellectual Property
Users must not misuse the Omah Martimbang website, attempt unauthorised access, interfere with website operations, upload malicious material, impersonate another person, submit false information or use the website for unlawful purposes.
Omah Martimbang's logos, photographs, videos, catalogues, website design, text, graphics, brand names and other visual or written materials may not be copied, reproduced, edited, distributed or commercially used without written permission.
23. Changes to These Terms
Omah Martimbang may update these Terms from time to time. For a Booking already validated by invoice and receipt, the version in force at the time the receipt is issued applies unless the parties agree otherwise in writing.
24. Severability and Governing Law
If a provision is invalid or unenforceable, the remaining provisions continue to apply. These Terms are governed by the laws of the Republic of Indonesia. Any dispute will first be discussed in good faith. If it cannot be resolved, it may be submitted to the competent courts of the Republic of Indonesia.
